Terms of Service

1. Acceptance of Terms

By accessing or using Servbase services, website, dashboard, or related platform features, you agree to these Terms of Service and related policies. If you do not agree, you must not use the service.

2. Eligibility and Account Responsibility

• You must provide accurate, current, and complete account information.
• You are responsible for safeguarding credentials and all activity under your account.
• You must promptly notify Servbase of unauthorized access or suspected security compromise.
• You may not share access in a manner that violates these Terms or security controls.

3. Services

Servbase provides platform services that may include application hosting, account management, billing, support, and related operational tooling.

Service features may evolve over time. We may modify, add, limit, or discontinue features, including plan terms and platform components, at our discretion.

4. Subscriptions, Billing, and Payments

• Servbase may offer free, paid, trial, promotional, or usage-based plan structures.
• Pricing, quotas, and included features may change from time to time.
• Billing and payment collection may be handled through third-party payment processors.
• Except where required by law or expressly stated, fees are non-refundable.
• Failed or disputed payments may result in suspension, feature restriction, downgrade, or account enforcement actions.

5. Acceptable Use and Prohibited Activities

You must use Servbase lawfully, responsibly, and in compliance with our Acceptable Use Policy and Fair Use Policy. Prohibited activity includes, without limitation:

• Phishing, credential harvesting, scams, impersonation, or deceptive/fraudulent operations.
• Malware distribution, harmful code hosting, unauthorized intrusion, exploitation, or security probing without permission.
• Spam, abusive automation, DDoS behavior, traffic flooding, or infrastructure abuse.
• Illegal activity or content, or content that violates third-party rights.
• Attempts to bypass platform limits, controls, or enforcement mechanisms.
• Harassment, hate-driven abuse, or behavior creating legal, security, or reputational risk to Servbase.

6. Enforcement Rights

Servbase may investigate suspected policy breaches and take action including, but not limited to, warning, throttling, content restriction/removal, suspension, service disablement, and account termination.

Where appropriate, Servbase may preserve logs/records and cooperate with lawful investigations or legal requests.

7. User Content and Hosted Content

• You are solely responsible for content, code, files, domains, configurations, and communications you upload, host, deploy, or publish through Servbase.
• You represent that you have the rights and authority to use and process such content.
• Servbase does not endorse user content and may remove or restrict content that violates these Terms or law.

8. Intellectual Property

Servbase and its licensors retain ownership of the platform, software, branding, interface, and related intellectual property rights.

You retain ownership of your user content. You grant Servbase a limited, non-exclusive license to host, process, transmit, and display user content solely as required to provide and secure the service.

9. Service Availability and Maintenance

We do not guarantee uninterrupted or error-free operation. Service may be affected by maintenance, infrastructure events, third-party dependencies, security incidents, force majeure, or other operational constraints.

10. Disclaimers

To the maximum extent permitted by law, Servbase services are provided on an "as is" and "as available" basis. Except where legally required, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement.

11. Limitation of Liability

To the maximum extent permitted by law, Servbase is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, revenues, data, goodwill, or business opportunities arising from use of or inability to use the service.

Where liability cannot be fully excluded, liability is limited to the amount legally permitted under applicable law.

12. Indemnification

You agree to indemnify and hold Servbase harmless from claims, losses, liabilities, penalties, and costs (including legal fees) arising from your misuse of the service, violation of these Terms, infringement of rights, or unlawful hosted content/activities.

13. Suspension and Termination

You may stop using Servbase at any time. Servbase may suspend or terminate access for violations, non-payment, security threats, abuse, legal risk, or operational integrity reasons.

Sections that by nature should survive termination (including billing obligations, IP, disclaimers, limitation of liability, indemnity, and legal compliance clauses) will survive termination.

14. Changes to Terms

Servbase reserves the right to modify, amend, or update these Terms at any time, including updates required for legal compliance, security posture, platform operations, or service model changes. Material updates may be posted and/or notified where appropriate. Where legally permitted, continued use of Servbase after updates become effective constitutes acceptance of the revised Terms.

15. Governing Law

These Terms are governed by and construed in accordance with the laws of the Republic of the Philippines, without prejudice to mandatory consumer protections under applicable law.

16. Legal Notice

These Terms are binding conditions of service between you and Servbase for your use of Servbase services.
